The Residence Nil Rate Band

With effect from 6th April 2017, a new inheritance tax relief came into force that could save the children of a married couple thousands of pounds in inheritance tax.

Unfortunately, rather than simply raising the inheritance tax threshold from its current rate of £325,000, which would have been much easier to understand, the ‘residence nil-rate band’ (‘RNRB’) was introduced.

Changes to debt recovery before commencing litigation in England and Wales from 1 October 2017

The implementation of the Civil Procedure Rules in 1999 brought in a new concept:  pre‑action protocols. 

The aim of these protocols was to encourage early engagement and communication between the parties with a view to enabling them to resolve matters without the need to start court proceedings and to save costs. 

However, it has taken the Ministry of Justice until 2017 to suggest a suitable pre-action protocol for the litigation of debts owed by one party to another.  This new protocol applies to any business debt, or claiming payment of a debt from an individual.

Possibly, in certain circumstances was the (slightly worrying) view of the High Court in the recent case of ICAP Management Services Ltd –v- Berry [2017]. 

Mr Berry was a senior executive in electronic broking with ICAP Management Services Ltd. He was placed in the garden (for his 12 month notice period) when he gave notice to join ICAPs main competitor; BGC.

These are two very common misconceptions. Many people think that Wills are only necessary for people with a great deal of wealth, but this is not the case. There are certain laws governing how a person’s estate is divided if they die ‘intestate’ (i.e. without a Will), which might not be what you would expect or intend. The intestacy rules determine who inherits your assets. The intestacy rules do not allow for you or your family to choose who receives your estate, which is distributed in accordance with the strict legal rules. According to statistics, one in three people die intestate in the UK every year.

Fletcher Day are proud to be hosting an exhibition of the paintings of Keith Jansz on 16th May 2017 at our office on the 7th Floor.

 “Keith Jansz took up the challenge when he became tetraplegic.  He had lost the use of his hands and legs in a tragic road accident in 1995, and was paralysed from the neck down.  He turned to painting, with the added challenge of painting with his mouth not his hands. To begin with Keith needed help, encouragement and inspiration, and he received these from fellow artists in the Mouth & Foot Painting Artists.  An active sportsman before his accident Keith knew what it was to push himself to his limits and this he now did with his painting, soon holding exhibitions of his work which attracted great interest and admiration. Keith’s work is full of light and colour.  Above all else it is full of joy.” (Professor Ken Howard, OBE, of the RA).
